This website is owned and operated by Christine Rogers, dba Chrissy Rogers Art. These Terms set forth the terms and conditions under which you may use my website and services as offered by me. This website offers visitors the opportunity to view and purchase original art. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

In order to use our website and/or receive our services, you must be at least the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.
The prices we charge for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page.

You agree to indemnify and hold Christine Rogers, dba Chrissy Rogers Art, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

To the maximum extent permitted by applicable law, in no event shall Christine Rogers, dba Chrissy Rogers Art, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.
To the maximum extent permitted by applicable law, Christine Rogers, dba Chrissy Rogers Art, assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.
Copyright
All images, whether they are of paintings, videos, or of photographs, displayed on this website and/or the artist's social media pages are exclusively owned by the artist and are copyrighted by law under section 106 of Title 17 of the United States Code effective in 1976. This bill gives owners, in this case Christine Rogers dba Chrissy Rogers, exclusive rights of reproduction, adaptation, publication, performance, and display. Copyright infringement is federal case, and judges can issue restraining orders, and injunctions to prevent distribution of infringing material. Money damages can range from $750 to $150,000 per infringement, and successful plaintiffs can also recover attorney fees. Copyright of artwork comes into effect as soon as it has been created and fixed in a tangible object. It does not need to be registered with the copyright office or have a copyright notice attached to receive copyright protection. A copyright lasts for the life of the artist, plus 70 years after the artist's death.
Payment Options
Please contact CRA with any questions or concerns regarding purchasing work. Payments are taken through PayPal including credit and debit cards, apple pay and google pay. You do not have to have a PayPal account to pay with a credit or debit card.
Availability
Work and/or the purchase option for individual works may be withdrawn from this website without any prior notice. This may happen for reasons such as work has been sold outside of the website or if work is committed to an exhibition or event for display. Please contact CRA with any questions regarding the art work that you are interested in.
Description
Please contact CRA with any questions or concerns regarding descriptions of work. It is the sincere intention to display the art on this website accurately, however, there is nothing like seeing a piece of art in person. There are many things that can interfere with how the art looks as its image communicates with different screens, browsers, different settings, and different devices.
Shipping
Please contact CRA with any questions or concerns regarding shipping of work. The shipping expense (US) for each work has been estimated based on size. Each work will be packaged with great care to protect it on its journey to you. Your purchase will be shipped within 5 calendar days insured and with tracking. You will receive your purchase usually within 2 weeks of initial purchase. A signature will be required upon your receiving your art. In the unlikely event that you receive your art damaged in any way please contact me within 7 calendar days of its arrival. Please take photographs of all damage.
International
Contact CRA if you are interested in purchasing art work but you are outside of the US. International sales are on a case by case basis. If an arrangement can be made there will be additional shipping charges. There are no returns for any work sold to buyers outside of the US.
Returns
Please contact CRA with any questions or concerns regarding CRA's return policy. It is my desire that each owner of my art will love and enjoy the work for as long as they own it. But if it happens that upon receiving your art that you are unhappy with it for any reason please contact me within 7 calendar days of receiving it. If after speaking with me it is concluded that you want to return your purchase you will be required to pack, ship, and insure it in like manner as it was sent to you at your cost. Upon my receiving the art back in new condition I will issue a full refund of the purchase price within 14 days.
